Maidencreek Township Board of Supervisor Meeting

Roy Timpe called the February 8, 2007 meeting of the Maidencreek Township Board of Supervisors to order at
7:00 PM in the Maidencreek Township Municipal Building and asked everyone to rise for the Pledge to the Flag.
POLICE REPORT
Officer Dillman reported that Northern Berks Regional Police responded to 235 assignments in Maidencreek
Township in the month of January. This resulted in 95 citations. Total patrol hours were 925.57 hours. Total
mileage was 7383.3. Total fines were $2,683.51.
APPROVAL OF THE MINUTES
A motion was made by Robert Kopfer, seconded by Claude Beaver, to approve the January 11, 2007
regular meeting minutes of the Maidencreek Township Board of Supervisors. All members voted, “Aye”. Motion
carried.
PUBLIC COMMENT
Ann Marie Carpenter of Cornerstone Drive stated that:
1.The Cornerstone playground is boring and needs updating.
2.A stop sign is needed on Cornerstone Drive.
3.Turning arrows are needed at Route 222 and Route 73.
4.Cactus growing alongside Spirit Court in a resident's yard are potentially dangerous if a child fell into them.
They have three inch thorns.
ENGINEER’S REPORT
Subdivision Status Checklist
Villages at Maidencreek Resubdivision Plan
A motion was made by Claude Beaver, seconded by Robert Kopfer, to accept the withdrawal of the plan entitled
“Resubdivision Plan of Record” in the letter dated February 2, 2007 from Van Cleef Engineering Associates on
behalf of Larken Associates. All members voted, “Aye”. Motion carried.
Village @ Summit Crest Phase III
A motion was made by Claude Beaver, seconded by Robert Kopfer, to accept the time extension that has been
received by the Township for the Village @ Summit Crest Phase III. All members voted, “Aye”. Motion carried.
Subdivision Improvements Agreements and Letter of Credit Reductions
A motion was made by Claude Beaver, seconded by Robert Kopfer, releasing the Meadowood Music
Maintenance Fund moneys. All members voted, “Aye”. Motion carried.
Subdivisions/Zoning
Maidencreek Crossings (Corrado)
A motion was made by Claude Beaver, seconded by Robert Kopfer, to accept the time extension letter that has
been received by the Township for Maidencreek Crossings. All members voted, “Aye”. Motion carried.

Water Well Ordinance
A motion was made by Claude Beaver, seconded by Robert Kopfer, authorizing SDE to forward the Draft Water
Well Ordinance to Maidencreek Township Authority and the Township Solicitor's office for review and possible
publication. All members voted “Aye”. Motion carried.
Bingo Hall Inspection
SDE inspected the property. The Bingo Hall is not in compliance with the meeting minutes. SDE sent out a
letter to Mr. Young explaining the noncompliance.
8 Chestnut Street
A motion was made by Claude Beaver, seconded by Robert Kopfer, to have the Road Working Crew board up
8 Chestnut Street working under the direction of the Property Maintenance Code. All members voted “Aye”.
Motion carried.
A motion was made by Claude Beaver, seconded by Robert Kopfer, amending the motion to have the Solicitor
review the Property Maintenance Code prior to beginning the work. All members voted “Aye”. Motion carried.

Subdivision Improvement Agreement LOC/Escrow Release Letters
A motion was made by Robert Kopfer, seconded by Claude Beaver, to authorize the Chairman to sign the
Subdivision Improvements Agreements LOC/Escrow release letters in the amount of $81,006.39 for the month
of January 2007. All members voted, "Aye." Motion carried.
Code Enforcement Officer's Activity Report
SDE advised the Supervisors that a letter had gone out to Ms. Bossler regarding her property on 185 W.
Wesner Road.
OPERATION’S REPORTS
Mr. Kopfer asked the Road Crew to inspect the road conditions on North View Road, in Limestone Village.
SOLICITOR’S REPORT

The Solicitor advised that he will not be be ready for readoption of the Zoning & Saldo Ordinance on March 8th
and asked that the hearing be postponed.

Ingot Drive deed of dedication
SDE has sent the legal description of the property to the Township Solicitor.
Sludge Ordinance
Mr. Kopfer, Mr. Beaver and Mr. Tom Unger visited the bunks (pits) on the Gerhard's Property as discussed at
the February 11, 2007 meeting. Mr. Kopfer asked how the pits can be safe when there are ground hog holes
bored in the sides of them. Mr. Kopfer stated that the pits are not lined, uncovered, have shrubs growing out of
them and are nothing more than a peat dump. Mr. Kopfer stated that it would not be a problem to cover the pits
if they would put a large enough divider between the two pits. Mr. Kopfer said that DEP stated that the pits
were fine and the water isn’t going to run out of the pit and down into the creek. Mr. Kopfer observed that the
creek is right down hill from the pits. Mr. Beaver asked if DEP states the bunks are okay and the permit states
that they must be covered and are not, what is the next step? Mr. Orlando said that the most effective thing to
do is make the local legislator’s office aware of the discrepancy between what the permit requires/states versus
what is actually being done.
Mr. Kline had a meeting with DEP and made Mr. Sweeney of the PA DEP aware that he is not looking to stop
the spreading of the sludge, but is looking for the pits to be covered. Mr. Sweeney told Mr. Kline that the
permit, which was submitted by Synagro, stated that they would cover the pits.
A motion was made by Claude Beaver, seconded by Robert Kopfer, to exclude from the ordinance the
coverage of the bunks, since it is already part of the DEP permit. All members voted “Aye”. Motion carried.
A motion was made by Claude Beaver, seconded by Robert Kopfer, to advertise the Public Hearing for the
adoption of the Draft Sludge Ordinance on March 8, 2007 at 6:30 PM. All members voted “Aye”. Motion
carried.
Mr. Beaver advised Ms. Hollenbach to put a notation on the web stating that the Draft Sludge Ordinance will be
revised.
Mr. Kline thanked Mr. Kopfer and Mr. Unger for stopping by his home on January 16, 2007 to look over his
situation and thanked Mr. Timpe for responding to his call of January 12, 2007.

TREASURER’S REPORT
A motion was made by Robert Kopfer, seconded by Claude Beaver, to approve the January 2007 Treasurer’s
Report and paid bills report. All members voted, “Aye.” Motion carried.
PARK & RECREATION
Ontelaunee Heights Neighborhood Park
A motion was made by Claude Beaver, seconded by Robert Kopfer, authorizing System Design Engineering to
survey the property with a cost not to exceed $2,500 and to obtain proposals to have a geologic evaluation
performed with the cost not to exceed $3,000 to determine the likelihood of the sinkholes spreading to other
areas of the site and obtain recommendations on sinkhole mitigation and repair. All members voted “Aye”.
Motion carried.
EMERGENCY MANAGEMENT – Tabled
BUSINESS
Public Access Computer
There will be no Public Access Computer due to cost.
Approval and signature of Boyer Agreement
A motion was by Robert Kopfer, seconded by Claude Beaver, authorizing the approval and signature of the
Boyer Agreement. All members voted “Aye”. Motion carried.
Certification for Foreign Fire Insurance Tax Disbursement & General Municipal Pension System State Aid
A motion was made by Robert Kopfer, seconded by Claude Beaver, authorizing the Chief Administrative Officer
to sign the Certification for Foreign Fire Insurance Tax Disbursement & General Municipal Pension System
State Aid. All members voted “Aye”. Motion carried.
Tree Topping Quotes at Genesis & Rt. 222
A motion was made by Robert Kopfer, seconded by Claude Beaver, authorizing the Public Works Director to
accept the lowest bid not to exceed $2,100.00 for tree topping on Genesis & Rt. 222. All members voted
“Aye”. Motion carried.
Property Maintenance Code of 2006
Currently, the Township has adopted the Property Maintenance Code of 2000. The Board did not wish to
authorize an ordinance be prepared to adopt the revised Property Maintenance Code of 2006.
Meetings
The Fleetwood Area School District Board invited the Supervisors to attend a meeting on February 20, 2007 at
7:00 PM.
Richmond Township invited the Supervisors to attend their Planning Commission meeting on Monday, February
26, 2007 at 7:00 PM, at which time Lehigh Cement will have representatives specifically explaining the quality
and quantity of truck activities needed to service their quarry expansion.
Executive Session was held from 8:45 p.m. to 9:20 to discuss litigation & personnel.
AFLAC
A motion was made by Robert Kopfer, seconded by Claude Beaver, allowing AFLAC to be offered to the
Township employees and authorizing the Township Secretary to sign on behalf of the Township. All members
voted “Aye”. Motion carried.
Since there was no further business, a motion was made by Robert Kopfer to adjourn the February 8, 2007
meeting of the Maidencreek Township Board of Supervisors. All members voted, “Aye.” Motion carried.
